Terms of Service
These Terms of Service (the "Terms") govern your use of the iPhone game "VELSIA: Star Ring Arena" (the "App") provided by BITCOINPAY K.K. ("we", "us"). By using the App you agree to these Terms.
1. Scope and relationship with Apple's EULA
- These Terms apply to all matters relating to your use of the App.
- Our Community Guidelines and any other rules we publish in the App or on our website ("Additional Rules") form part of these Terms. If these Terms and any Additional Rules conflict, these Terms prevail unless the Additional Rules say otherwise.
- These Terms supplement Apple's Licensed Application End User License Agreement (the "Apple EULA"). If they conflict, these Terms govern in-game items, currencies and the online features, and the Apple EULA governs all other matters.
- These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
2. Definitions
- "Paid Items": in-game currencies and items obtained through In-App Purchases.
- "Astral Gems": an in-game currency. "Paid Gems" are obtained through In-App Purchases (including any bonus included with a purchase); "Free Gems" are granted free of charge as in-game rewards.
- "Starlight Coins": an in-game currency granted free of charge through gameplay.
- "Content": heroes, skins, emotes and other digital content available in the App.
- "Online Features": online matches (on the same local network or with a room code), spectating, friends, party invitations and any other feature that lets you communicate with other users through the App.
- "Display Name": the player name you set in the App.
- "Friend Code": a code the App creates on each device to identify you in the friend feature.
- "Relay Server": the server we operate for the Online Features.
3. Minors
- If you are a minor, you must obtain the consent of a parent or legal guardian before agreeing to these Terms and using the App, including the Online Features.
- The App limits monthly purchases based on the age group you select (15 and under: JPY 5,000; 16 to 19: JPY 10,000).
- If a minor misrepresents their age group to make a purchase, the purchase may not be cancellable under Article 21 of the Civil Code of Japan.
4. License
We grant you a non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms and the Apple EULA.
5. In-game currencies and items
- Astral Gems and Starlight Coins can only be exchanged for Content within the App. They have no cash value and cannot be refunded, exchanged for money, or transferred or lent to anyone else, except where refunds are required by law.
- When you spend Astral Gems, Free Gems are used first, and Paid Gems are used only for the remaining amount.
- Paid Gems do not expire. The information required under Japan's Payment Services Act is set out separately in our Payment Services Act notice.
- Paid Items change appearance and similar content only; they never increase in-match combat power.
- Your game progress, items, currency balances and other game data are stored on your device, not on our servers. We cannot restore data lost because a device is lost, broken or reset, or because the App was deleted. Use the App's backup feature as needed.
6. Purchases
- Purchases are processed by Apple through the App Store and are subject to Apple's terms.
- Purchased items are granted immediately after the purchase completes. If delivery is delayed, relaunch the App to receive them.
7. Refunds
Because of the nature of digital content, purchases cannot be cancelled or returned. Refund requests are handled by Apple (https://reportaproblem.apple.com). If Apple issues a refund, we may revoke the Paid Gems or items granted by that purchase.
8. Online Features
- To use the Online Features, you must accept the Community Guidelines and these Terms in the App. Users under 13 cannot use the Online Features.
- In an online match, one participant's device (the "Host") runs the match, and information is exchanged between participants' devices either directly over the same local network or through the Relay Server.
- When you use the Online Features, your Display Name and the other information described in our Privacy Policy are shown to other users or sent to and stored on their devices.
- Anyone who knows a room code, and anyone on the same local network, can join or spectate a room without the Host's approval. You are responsible for deciding who you give your room codes and Friend Code to.
- The Host can remove participants from the room, and you can block other users.
- If the Host's connection drops or the Host closes the room, the match may end without being completed.
- The Online Features may be unavailable, delayed or disconnected depending on your network, your device or the status of external services we use.
9. Display Names and your conduct
- You are responsible for your Display Name and for what you do in the Online Features.
- Your Display Name must not infringe anyone's rights; contain sexual, violent, discriminatory or otherwise offensive language; impersonate another person or us; or include information that identifies you or others, such as a real name, contact details or social media handles.
- You must follow the Community Guidelines when using the Online Features.
10. Prohibited conduct
You must not:
- violate any law or public order;
- modify, reverse engineer, decompile or disassemble the App, except as permitted by law;
- tamper with or duplicate App data or in-game currencies by unauthorized means;
- sell or transfer App data, items or Friend Codes for money (real-money trading);
- infringe the intellectual property, reputation, privacy or other rights of us or others;
- harass, threaten, discriminate against, defame or stalk other users;
- show other users sexual, violent, discriminatory or otherwise inappropriate content, or other people's personal information, through your Display Name or otherwise;
- impersonate other users or us, or use another user's identifiers to take over their seat or connection;
- use modified versions of the App or third-party tools, exploit bugs, interfere with connections, or otherwise undermine fair play;
- deliberately go idle, help the opposing team, or collude to fix the outcome of a match;
- repeatedly send unwanted friend requests or invitations, or advertise or solicit;
- place excessive load on, gain unauthorized access to, or otherwise interfere with the operation of the App or the Relay Server;
- submit false reports; or
- engage in any other conduct we reasonably consider inappropriate.
11. Reports and enforcement
- We do not tolerate objectionable content or abusive users. If you believe another user's Display Name or conduct violates these Terms or the Community Guidelines, you can report it to us through the reporting feature in the App or by email.
- When we receive a report, we will promptly review the information provided by the reporter and act on it. Our target response times are set out on the Reporting and Blocking page.
- We do not inspect or record the content of traffic forwarded by the Relay Server. You agree that, to handle reports, we may review information provided by the reporter, such as the other user's Display Name, Friend Code and screenshots.
- If we reasonably determine that you have violated these Terms or the Community Guidelines, we may, without prior notice, restrict your use of all or part of the Online Features (including suspending your Friend Code) or take other necessary measures.
- If you disagree with a measure taken under the previous paragraph, you may contact us at the address in section 18 within 30 days after you become aware of it. We will review your objection and let you know whether the measure stays in place or is lifted.
12. Disputes between users
You are responsible for resolving any dispute with other users that arises through the Online Features, except where the dispute arises from causes attributable to us.
13. Changes, suspension and discontinuation
- We may change or discontinue the App. We will give reasonable advance notice of discontinuation in the App or on our website.
- We may temporarily suspend all or part of the Online Features, including the Relay Server, for maintenance, to deal with failures, because of changes to external services, or for other unavoidable reasons. Except in emergencies, we will announce the suspension in advance in the App or on our website.
- We may end all or part of the Online Features after giving reasonable advance notice in the App or on our website.
- If discontinuation of the App makes unused Paid Gems unusable, we will refund them in accordance with the Japanese Payment Services Act, and announce the procedure when we give notice.
14. Intellectual property
All intellectual property rights in the App belong to us or to their rightful owners. The license in these Terms does not transfer any such rights.
15. Disclaimer and limitation of liability
- The App is provided without warranties of any kind, to the extent permitted by law. We will make reasonable efforts to fix defects we become aware of.
- We are not liable for damages arising from your use of the App except in cases of our willful misconduct or gross negligence.
- Where we are liable for ordinary negligence (including where consumer protection law applies), our liability is limited to the amount you paid in the App during the month in which the damage occurred. This limitation does not apply to willful misconduct or gross negligence.
- We are not liable for damages caused by other users' conduct, or by delays or disconnections not attributable to us (including those caused by the Host's or your network or by failures of external services we use).
16. Changes to these Terms
We may change these Terms. We will announce the changes and their effective date in the App or on our website a reasonable time in advance. For material changes that limit your rights, we will ask for your consent again in the App.
17. Governing law and jurisdiction
These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction in the first instance over any dispute relating to the App.
